Terms of Service
These Terms govern access to gignam.me, app.gignam.me, and related Gignam apps and services (the “Service”). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.
What Gignam is
Gignam is a personal reflection product: a map of life in weeks, intentions, captures, and related tools so you can notice whether the life you are living matches the life you chose. It is not medical, therapeutic, legal, or financial advice. Insights and syntheses are assistive reflections, not predictions of your future or professional diagnosis.
Eligibility
You must be at least 13 years old (or the higher age of digital consent in your place of residence) and able to form a binding contract. You are responsible for the accuracy of the information you provide and for keeping your login credentials secure.
Your account and content
- You retain ownership of the journal entries, intentions, media, and other content you create (“Your Content”).
- You grant us a limited license to host, sync, display, and process Your Content solely to operate and improve the Service for you.
- You must not upload content that is unlawful, infringes others’ rights, or abuses the Service (malware, spam, scraping that harms availability, or attempts to access other users’ data).
- Cloud sync stores Your Content with our providers so you can use Gignam across devices. By signing up, you agree to that processing as described in the Privacy Policy.
Acceptable use
You agree not to:
- Reverse engineer or disrupt the Service except as allowed by law
- Misrepresent identity or bypass security or rate limits
- Use the Service to harm others or violate applicable law
- Resell or sublicense the Service without our written permission
Plans and payments
Some features may require a paid plan. Prices, billing intervals, and entitlements are shown at purchase. Unless stated otherwise, fees are non-refundable except where required by law. We may change pricing with notice for renewals. Failed payments may suspend paid features.
Intellectual property
The Service, branding, design, and software (excluding Your Content) are owned by Gignam or its licensors. These Terms do not transfer ownership of that IP to you.
Availability and changes
We aim for a reliable Service but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features with reasonable notice when practicable. We may update these Terms; continued use after the “Last updated” date means you accept the revised Terms.
Disclaimer
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. Reflection tools can change how you see your life; use them with care.
Limitation of liability
To the fullest extent permitted by law, Gignam and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising from your use of the Service. Our aggregate liability for claims relating to the Service is limited to the greater of (a) amounts you paid us for the Service in the twelve months before the claim or (b) USD 50, except where liability cannot be limited under applicable law (including consumer protections that apply to you).
Termination
You may stop using the Service and request account deletion at any time. We may suspend or terminate access if you breach these Terms or if we must do so for legal or security reasons. Provisions that by nature should survive (including IP, disclaimers, and liability limits) survive termination.
Governing law
These Terms are governed by the laws of Brazil, without regard to conflict-of-law rules, except where mandatory consumer law in your place of residence provides otherwise. Disputes should first be raised with us at info@gignam.me.
